- Bars district courts from issuing injunctions that reach beyond the parties to the case, except relief for non-parties represented by a party acting in a representative capacity under the Federal Rules of Civil Procedure.
- Requires lawsuits brought by two or more States from different circuits challenging an executive branch action to go to a three-judge panel chosen at random rather than by the circuit's chief judge.
- Allows that panel to issue an injunction otherwise barred, weighing the interest of justice, the risk of irreparable harm to non-parties, and the preservation of separation of powers.
- Permits appeals of those panel orders to the circuit court or the Supreme Court, at the party's preference.
