- Defines "remote access" as access by a foreign person through a network connection, including the internet or a cloud computing service, from a location other than where the item is physically located, when the Secretary determines the item's use could pose a serious risk to national security or foreign policy.
- Adds remote access to the existing licensing, penalty, and regulatory provisions of the Export Control Reform Act of 2018, so that those provisions cover remote access alongside exports and in-country transfers.
- Requires the Secretary of Commerce to keep the House Committee on Foreign Affairs and the Senate Committee on Banking, Housing, and Urban Affairs fully and currently informed about planned remote access regulations, including the national security risk, how the rules address it, and their economic impact, in a classified setting when necessary.
- States that the congressional consultation requirement does not make committee approval a condition for using the Act's authorities.
